It includes clear placeholders so group members can personalize their messages before emailing the trustee. ===== Subject: Omission of Creditors and Undisclosed Assets – DE Marketing LLC Bankruptcy (Case No. 4:25-bk-33305) ===== To: rsommers@nathansommers.com CC (optional): pbuenano@nathansommers.com Dear Trustee Sommers, I am writing to you as a creditor in the Chapter 7 bankruptcy case of DE Marketing LLC (Case No. 4:25-bk-33305, Southern District of Texas). I am also part of a group of over 3,000 independent contractors who were issued 1099s by the company for unpaid commission earnings, totaling more than $2 million. After reviewing the court filings, we have identified several serious issues that suggest potential omission of creditors and concealment of assets: * The creditor matrix filed lists only a few entities (primarily lenders and service vendors) and omits all known independent contractors, despite clear documentation of earnings and 1099 tax filings. * The Certificate of Notice (dated June 12, 2025) confirms that no other creditors were notified, by mail or email. * Websites tied to DE Marketing — including Cliqly.com and ConversionHouseMedia.net — are still operational and appear to be collecting revenue or leads. * The owner of DE Marketing appears to be continuing similar operations through a new entity named Clickerr, as well as promotional platforms MyInboxPro and Push Platform, using what appears to be the same email list and dashboard infrastructure. These omissions raise serious concerns under bankruptcy rules and 11 U.S.C. §§ 521 and 541. Based on this evidence, we respectfully request that you: # Investigate whether the debtor failed to disclose key assets and legitimate creditors; # Consider using Rule 2004 discovery powers to examine the transfers and operations of the successor business; # Prevent case closure until these issues are fully addressed and all creditors have had a chance to participate. Please find attached: * My completed creditor declaration * My 1099 or dashboard screenshots (optional) * [Optional: Complaint Packet prepared for your review] I appreciate your attention and am happy to coordinate further with other affected members if needed. Sincerely, [YOUR FULL NAME] [YOUR EMAIL ADDRESS] [YOUR PHONE NUMBER] [YOUR MAILING ADDRESS] ===== 1. Paste this into a new Google Doc. ===== # Replace all the [BRACKETED] sections with your information. # Set sharing to: “Anyone with the link can view/comment.” # Share the link with your group. Let me know if you’d like a group-wide checklist, or if you want me to generate a short intro paragraph to send along with the Google Doc link.
